The Strategic Response Agenda®

The National Labor Relations Board (NLRB) possesses the right to change its rules and regulations.  If it so desires, it may impose new methods and procedures for its handling of representation cases.  Thus, it is likely this pro-labor Board will proceed this year with its plan to change its representation election procedure. The only preemptive action Congress possesses is the unlikely defunding of the National Labor Relations Board.  Post-election litigation before the federal judiciary may likely fall on deaf ears.
